Commercial Litigation and Bankruptcy Practice


Kahn Kruse’s principal practice is in the area of commercial and bankruptcy litigation. The Firm represents commercial clients, lenders, secured and unsecured creditors within and without bankruptcy. The Firm has extensive experience in representing creditors and debtors in Chapter 11 reorganizations and Chapter 7 liquidations, whether filed voluntarily or involuntarily. Kahn Kruse has successfully prosecuted and defended numerous equitable subordination actions, preference recovery and fraudulent conveyance actions, lien priority litigation brought by trustees in bankruptcy, debtors-in-possession or unsecured creditors committees, together with a variety of other bankruptcy litigation matters.

Several recent significant bankruptcy representations are exemplified by:

* Representation of a European manufacturer of construction equipment parts in a federal litigation and concurrent Chapter 11 bankruptcy case in the middle district of Florida. In this matter, we established our client’s unsecured claim as a special class of creditor and obtained a recovery of 100% of the claim and pre-petition interest ($2,400,000.00).

* Representation of a business debtor in the securities industry in several adversarial discharge proceedings with defense verdicts obtained in significant seven figure claims.

* Representation of a corporate telecommunications creditor in multistate (Ohio and Nevada) federal RICO litigation with a companion bankruptcy case. Our results included complete dismissal of the estate’s RICO claims and a dismissal of the concurrent claims in bankruptcy.
